Terms of Service

These Terms of Service ("Terms") are between you and Lumakaizo LLC, the owner and operator of MyProjectPreview. They govern access to and use of the MyProjectPreview website, waitlist, software, AI preview tools, project proposal features, shared client links, emails, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
1. Who May Use the Service
You must be at least 18 years old to use the Service. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
2. What the Service Does
MyProjectPreview helps contractors create visual project quotes and related proposal materials. The Service may include waitlist signup, project photo uploads, AI-generated visual previews, project summaries, sales pitch drafts, line-item suggestions, client review links, proposal management, email notifications, subscription billing, and related contractor workflow tools.
The Service is a software platform. It is not a contractor, architect, engineer, designer, permit expediter, inspector, legal advisor, payment escrow provider, or construction dispute mediator.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information, keep it current, and notify us promptly if you suspect unauthorized access or a security issue.
4. Contractor Responsibilities
If you are a contractor or business user, you are solely responsible for:
- Holding and maintaining required licenses, registrations, permits, insurance, bonds, and qualifications.
- Complying with building codes, zoning rules, safety requirements, consumer-protection laws, advertising rules, and trade-specific regulations.
- Ensuring proposals, prices, measurements, timelines, warranties, and contract terms are accurate and lawful.
- Obtaining client consent before uploading or sharing personal information, project photos, property information, or other third-party content.
- Reviewing all AI-generated or suggested content before sending it to clients.
- Making clear to clients when an image is a conceptual preview and not a guaranteed final result.
5. Client Viewers and Shared Links
Contractors may use the Service to send proposal or preview links to clients. Client viewers should understand that MyProjectPreview does not verify, license, insure, employ, recommend, or endorse contractors. Any construction contract, project, payment, warranty, or dispute is between the contractor and client, not MyProjectPreview.
If you receive a shared proposal link, you are responsible for your own due diligence, including confirming contractor licensing, insurance, references, scope, materials, permits, pricing, contract terms, and compliance with local laws.
6. AI-Generated Content
The Service uses artificial intelligence to generate or analyze images and text. AI-generated previews, summaries, suggestions, and sales copy are for illustrative, drafting, and communication purposes only. They may be inaccurate, incomplete, unrealistic, non-compliant, or inconsistent with site conditions, product availability, dimensions, structural needs, codes, permit requirements, manufacturer specifications, or final work.
You must review and verify all AI-generated content before relying on it, publishing it, or sending it to a client. AI-generated content is not professional architectural, engineering, design, legal, tax, financial, construction, or safety advice.
7. Your Content and Permissions
You retain ownership of photos, prompts, project information, proposal content, client information, feedback, logos, and other materials you submit to the Service ("User Content"). You grant MyProjectPreview a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, display, transmit, and create outputs from User Content as needed to provide, secure, support, and improve the Service.
You represent that you have all rights, permissions, notices, and consents needed to submit User Content and to allow us and our service providers to process it. Do not upload confidential, regulated, sensitive, infringing, or third-party content unless you are authorized to do so.
8. Acceptable Use
You agree not to:
- Use the Service for unlawful, deceptive, fraudulent, unsafe, or harmful purposes.
- Upload content that infringes intellectual-property, privacy, publicity, or other rights.
- Misrepresent AI previews as guaranteed final results, construction documents, code approvals, or professional certifications.
- Use the Service to create or distribute spam, malware, harassment, discriminatory content, or misleading claims.
- Attempt to access accounts, systems, data, or areas of the Service without authorization.
- Probe, scan, overload, scrape, reverse engineer, or interfere with the Service or its security controls.
- Bypass rate limits, usage limits, plan limits, or technical restrictions.
- Use the Service to process data in violation of privacy laws or contractual obligations.
9. Third-Party Services
The Service relies on third-party providers such as Supabase, Google Gemini, Stripe, Resend, hosting, storage, logging, and infrastructure providers. Your use of some features may also be subject to third-party terms, policies, or availability. We are not responsible for third-party services outside our control.
10. Subscriptions, Fees, and Billing
Some features may require a paid subscription or usage-based fee. If you purchase a paid plan, you authorize us and our payment processor to charge the applicable fees, taxes, and renewal charges using your selected payment method. Subscriptions may renew automatically unless canceled before the renewal date. Fees are non-refundable except where required by law or expressly stated in writing.
We may change pricing or plan features prospectively. If we make material changes to paid subscriptions, we will provide notice where required.
11. Intellectual Property
The Service, including our software, design, branding, workflows, documentation, and non-user content, is owned by MyProjectPreview or its operator, Lumakaizo LLC, or their licensors and is protected by intellectual-property laws. These Terms do not grant you ownership of the Service or our intellectual property.
12. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you agree that we may process information as described in the Privacy Policy.
13. Beta, Pre-Launch, and Changes to the Service
Parts of the Service may be offered as pre-launch, beta, preview, or early access features. These features may change, break, be rate-limited, or be discontinued at any time. We may add, remove, suspend, or modify features as we develop and operate the Service.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms, created risk for us or others, failed to pay fees, or used the Service in a way that may harm the Service, users, clients, or third parties. Upon termination, your right to use the Service ends immediately, but provisions that by their nature should survive will continue to apply.
15. Disclaimers
To the maximum extent permitted by law, the Service and all outputs are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.
We do not warrant that AI outputs will be accurate, that proposals will win work, that clients will approve projects, that contractors will perform satisfactorily, or that the Service will meet every business or legal requirement.
16. Limitation of Liability
To the maximum extent permitted by law, MyProjectPreview and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost revenue; lost business; lost data; project delays; construction defects; contractor-client disputes; or costs of substitute services.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MyProjectPreview and its affiliates, officers, employees, agents, suppliers, and licensors from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your use of the Service, your projects or proposals, your relationship with clients or contractors, your violation of these Terms, or your violation of law or third-party rights.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to any mandatory rights you may have under local law, the state and federal courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Service.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update this page and may provide additional notice where required. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
